TERMS FOR YOU ATTENDING THE LIVE AUCTION:
AUCTION DATE & LOCATION: The auction will be held on Tuesday, January 13, 2026 at 11:07 am CST at Whispering Woods Hotel and Conference Center Oak Room, 7300 Hacks Cross Road, Olive Branch, Mississippi, located just 5 minutes from the Olive Branch Airport (OLV/KOLV)) if you are flying in. The Metro Airport number is 662-895-2978. Enterprise Rental cars are available at the airport. Hotel rooms are available at Whispering Woods. Call for reservations.
TERMS OF THE SALE: A 10% (ten percent) buyer’s premium will be applied to your bid price to determine the gross sales price of the contract. You will be required to make a 10% (ten percent) deposit of the gross sales price on the day of the auction in the form of check or cash. If paying by check, you are required to bring a letter from your bank guaranteeing your check to be good or approved by the Auctioneer. You may bring a Cashier’s Check made payable to yourself that you will endorse it over to the Auction Company. Otherwise bring a letter from your bank or email it to John@roebuckauctions.com.
CLOSING: The closing is to be within 45 (forty-five) days after the auction subject to court approval. Closings will take place at the offices of Closing Coordinator Rob M. Draughon, III, 6489 N Quail Hollow Rd, Suite 100, Memphis, TN 38120, telephone (901)752-1133 and email: rob@gcemlaw.com.
CONDITIONS: All properties are selling “AS IS, WHERE IS” with all faults and is selling subject to easements, leases, restrictions, covenants, conditions, zoning, HOA and POA fees, and all other seller matters which would be revealed by a current survey or an inspection of the property or which is contained in public records. Selling with no warranties whatsoever other than good marketable title.

BROKER PARTICIPATION: A 2% (two percent) commission of the high bid before adding the buyer’s premium will be paid to any qualified licensed real estate broker in the state where the property is located and whose prospect is the successful bidder at the auction and closes on the property. To qualify for a commission, the broker must first register the prospect online by completing the broker registration form on the Roebuck Auction website and email it to john@roebuckauctions.com. The registration form must include the prospective purchaser, the signature of the broker and the broker’s real estate license number. It must be received by the Auctioneer at least 24 (twenty-four) hours prior to the auction. UNDER NO CIRCUMSTANCES WILL THE BROKER REGISTERATION BE ALLOWED ON THE DAY OF THE AUCTION. In addition, to qualify for a commission the broker must attend the auction with their prospect. A commission on a property will be paid only to the first broker to register a prospect. A Broker/Agent cannot act as principal and broker/agent on the same transaction.
TERMS FOR YOU ONLINE BIDDERS
TERMS OF THE SALE: A 10% (ten percent) buyer’s premium will be applied to your bid price to determine the gross sales price of the contract. You must be pre-qualified in order to bid. Be sure to follow the terms of the auction. In order to bid you are required to provide a letter guaranteeing funds from your bank or financial institution. You may email it to John@roebuckauctions.com. Once you are approved by the Auctioneer, you may register to bid. On certain properties, you will be required to send a deposit by wire transfer to the closing attorney’s Escrow Account at least 24 (twenty-four) hours prior to the auction. For example, the deposit to bid on the apartments is $100,000 and the deposit to bid on each storage unit location is $50,000. If you are not the winning bidder, your deposit will be returned within 72 (seventy-two) hours after the auction. If you are the winning bidder, you are required to sign a sales contract and submit a 10% (ten percent) deposit of the gross sales price. Your wire transfer will be applied to the deposit.
